What Are the Requirements to File for Divorce?
To file for divorce in Virginia, at least one spouse must have lived in the state for a minimum of six months. The couple must also live “separate and apart” without cohabitation for a mandatory waiting period before filing for a no-fault divorce. The required time depends on your circumstances.
